CONFLICT OF INTEREST IN ASSIGNMENT ОF PROCUREMENT FINANCED BY THE STRUCTURAL FUNDS OF THE EUROPEAN UNION:DECLARING LACK OF CONFLICT OF INTEREST

The policy of the Union cohesion for the programming period 2014-2020 s Member States to develop Anti-Fraud measures in the management of structural actions. One of the key moments in the process of assignment and execution of public procurement is the presence of a conflict of interests, which creates preconditions of illegality when conducting procedures. The recommendation by the European Commission and OLAF is for implement of policy on conflict of intereststhat is conformed with the national law of the Member State. The implementation of this policy s a number of administrative actions to Managing Authority, Intermediate Body, contractor or beneficiaries related to the passing, verification and the actions in declaring the circumstances of conflict of interests. Detailing the specific steps and circumstances of each stage is a prerequisite for reducing and overcoming availability of conflict of interests. Taking actions are directly related to commitments to the relevant authorities for protection of the financial interests of the community.
